NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated June 23, 2017, and the Deed of Trust of even date securing the same, recorded July 3, 2017, in Book No. TD144, at Page 446, in Office of the Register of Deeds for Clay County, Tennessee, executed by David W Zeoli and Maria Zeoli, conveying certain property therein described to Mark Rosser as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Freedom Mortgage Corporation, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Freedom Mortgage Corporation.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Freedom Mortgage Corporation, will, on October 30, 2019 on or about 1:00 PM, at the Clay County Community Building, Celina, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Clay County, Tennessee, and being more particularly described as follows:

The following described real property situated in Clay County, State of Tennessee: Lying and being in the First Civil District of Clay County, Tennessee, and being more particularly described as follows: Beginning at a 1/2″ rebar (new) set at the base of a wood post called for being the northwest corner of the lands of Herman C. Collins, et ux, Deed Book 40, Page 663, said rebar being in the southern right-of-way of the Creed Hestand Road, 16′ left and right of center, thence leaving the said right-of-way and along the western boundary of the lands of Collins and along the fence S 09 deg 16′ 04″ W 644.11′ to a 1/2″ rebar (new), said rebar being a new corner of the lands of Larry Head, Deed Book 88, Page 302, thence leaving the land of Collins and the fence and severing the lands of Larry Head N 32 deg 36′ 48″ W 732.97′ to a 1/2″ rebar (new) set at the aforesaid right-of-way of the Creed Hestand Road, thence leaving the lands of Larry Head and along the aforesaid right-of-way as follows; N 57 deg 14′ 08″ E 22.20′ to a 1/2″ rebar (new); N 65 deg 02′ 37″ E 50. 76′ to a 1/2″ rebar (new); N 70 deg 41′ 42″ E 92.98′ to a 1/2″ rebar (new); N 89 deg 30′ 37″ E 89.37′ to a 1/2″ rebar (new); S 80 deg 15′ 51″ E 112.87′ to a 1/2″ rebar (new); S 71 deg 04′ 40″ E 92.37′ to a 1/2″ rebar (new); N 87 deg 37′ 53″ E 58.42′ to the beginning and containing 4.00 acres by survey. Actual field survey performed by Michael W. Asberry, P.L.S. #1653, on the 27th day of June 2007.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
