NOTICE OF TRUSTEE’S SALE

 

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated October 29, 2007, and the Deed of Trust of even date securing the same, recorded November 2, 2007, in Book No. TD109, at Page 639, in Office of the Register of Deeds for Clay County, Tennessee, executed by Lois B Grider-Brady and Roger Brady, conveying certain property therein described to John O. Rhea as Trustee for National City Mortgage a division of National City Bank; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PNC Bank, National Association.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PNC Bank, National Association, will, on March 20, 2019 on or about 1:00 PM, at the Clay County Community Building, Celina, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Clay County, Tennessee, and being more particularly described as follows:

The following described tract or parcel of land located in the FIRST CIVIL DISTRICT OF CLAY COUNTY, TENNESSEE, as follows: Beginning on a new 1/2 “ pipe at the north r.o.w. of Tennessee Highway 52, the southeast corner of the tract of land herein described, a point in the boundary of a tract of land belonging to Leon Birdwell (Deed Book 50, page 634), and the southeast corner of the parent tract; Thence leaving Birdwell, and with the north r.o.w. of the Highway, North 76 degrees, 01 minutes, 30 seconds West 82.03 feet to a new 1/2” pipe, the southwest corner of the tract of land herein described; Thence leaving the r.o.w., and severing the parent tract, the following calls: North 0 degrees, 40 minutes, 44 seconds East 173.84 feet to a new 1/2” pipe, North 64 degrees, 18 minutes, 37 seconds West 70.02 feet to a new 1/2” pipe, North 3 degrees, 07 minutes, 06 seconds West 132.34 feet to a new 1/2” pipe, the northwest corner of the tract of land herein described, and North 77 degrees, 04 minutes, 33 seconds East 164.96 feet to a steel post in a fenceline at a triple allanthus, the northeast corner of the tract of land herein described, a point in the aforementioned tract of land belonging to Leon Birdwell, and a point In the outer perimeter of the parent tract; Thence with Birdwell and the fenceline. South 3 degrees, 43 minutes, 37 seconds West 110.24 feet to a wood post; Thence leaving the fenceline, and continuing with Birdwell, South 0 degrees, 58 minutes. 19 seconds West 282.84 feet to the point of beginning, containing 0.939 acres as surveyed by Carlen J, Wiggins, R.L.S. 70, plat dated September 20, 2002, and being a portion of lands contained in Deed Book 40 at page 354 in the Register’s Office of Clay County Tennessee.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
